These General Terms (“Terms”) govern your access to and use of Unbound (the “Platform”) and related services (the “Services”) provided by Fx Technology LTD (“Fx Technology LTD”, “Fx Technology”, “we”, “us”, or “our”).

By purchasing, accessing, activating, or using any Unbound eSIM or related Services, or by browsing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Platform or Services.

1. Who We Are

Unbound is a global data connectivity service operated by Fx Technology LTD. We act as an aggregator and marketplace of connectivity services: we work with network operators and service providers around the world to make their eSIM and connectivity services available to you through Unbound.

Our Services may be provided directly by us or through third-party partners and network operators.

2. Scope of These Terms & Related Policies

These Terms apply to all use of our Platform and Services. In particular:

  • These General Terms always apply.
  • The Terms of Use of our Services (included in this document) apply where you use our eSIMs and related connectivity Services.
  • If you access our Services through a third party (for example, your employer or one of our partners), these Terms still apply but should be read together with your agreement with that third party. In such cases:
    • you may not have access to all features (such as direct customer support from us);
    • you may be subject to different pricing, payment, and refund processes; and
    • we are not responsible for any actions of that third party or your agreement with them.

The following policies also apply and form part of these Terms (collectively, the “Unbound Terms”):

Your use of the Platform and Services is conditional on your acceptance and continued compliance with the Unbound Terms.

3. The Platform and Services

3.1 Platform

The Platform includes:

  • our website(s) and web pages;
  • our mobile or web applications; and
  • pages or content managed by Fx Technology LTD and hosted on third-party or social media platforms.

3.2 Services

Our Services include, without limitation:

  • provision of eSIMs and mobile data connectivity in supported countries or regions;
  • tools for purchase, activation, management, and top-up of eSIMs;
  • associated customer support and technical assistance (where applicable).

Unless explicitly stated, our Services do not include voice calling or SMS. Availability, speed, and quality of data connectivity depend on third-party network operators and may vary.

We do not guarantee uninterrupted service, specific data speeds, or coverage in any given area.

4. Eligibility and Lawful Use

By using Unbound, you confirm that:

  • you are at least 18 years old, or you have obtained parental or guardian consent;
  • you will use the Platform and Services only for lawful purposes and in accordance with these Terms and applicable laws.

We may suspend or terminate your access if we reasonably suspect fraudulent, abusive, or illegal activity, or any breach of these Terms.

5. Registration, Accounts & Access

Unbound may be accessed with or without creating an account:

  • Some Services may not require account registration or KYC verification.
  • In some cases, account creation may be required (for example, for managing multiple eSIMs or using support features).

Where you create an account:

  • you must ensure that your information is accurate and up to date;
  • you are responsible for maintaining the confidentiality of login credentials;
  • you are responsible for all activities under your account.

We may suspend or terminate accounts if we believe they are compromised or used in breach of these Terms.

6. Payments, Pricing & Refunds

6.1 Payments

  • Payment is required at the time of purchase of any eSIM or Service, unless otherwise agreed.
  • We may accept various forms of payment, including cards, digital wallets, and (where offered) cryptocurrency.
  • All pricing, charges, and taxes will be shown at checkout.

6.2 Refunds

Unless otherwise stated in our Refund Policy:

  • All purchases are final and non-refundable, including for:
    • unused data,
    • service interruptions outside our control,
    • user activation/configuration errors.

Refunds may be granted only if:

  • we fail to deliver an eSIM after successful payment, or
  • a service disruption occurs due to a fault on our side.

Payments made with cryptocurrency (where applicable) are non-refundable.

7. Privacy, Data Usage & No-Logs Approach

Fx Technology LTD operates with a minimal-data philosophy.

  • We do not store, track, or log browsing history, call/SMS details, or real-time location for profiling or marketing.
  • We collect only the minimum information needed to process payments, provide Services, comply with legal requirements, and secure our systems.

Our Privacy Policy and Cookie Policy explain our data practices. By using Unbound, you acknowledge and agree to them.

Where legally required, we may comply with lawful government or regulatory requests. However, we do not maintain logs that would allow us to reconstruct detailed user activity unless mandated by applicable law.

8. Service Limitations, Fair Use & Third-Party Networks

8.1 Third-Party Networks

Our Services rely on third-party telecommunications networks. Therefore:

  • coverage, speed, and quality vary by operator and location;
  • we do not control network congestion, throttling, or downtime;
  • local carriers may impose their own restrictions or fair use policies.

We are not responsible for variations or interruptions caused by external networks.

8.2 Fair Use

To protect network integrity, Fx Technology LTD may apply fair use rules. Excessive or abusive usage may result in:

  • speed limitations,
  • restricted access,
  • suspension or termination.

9. Prohibited Uses

You may not use Unbound for:

  • fraud, spamming, phishing, or distributing malware;
  • bypassing geo-restrictions or violating telecom regulations;
  • unauthorized resale or redistribution of Services;
  • interfering with network integrity or attempting to breach systems;
  • any unlawful activity under applicable law.

We may suspend or terminate access without refund if prohibited use is detected.

10. Third-Party Platforms & Links

Our Platform may contain links to third-party websites or be hosted partly on third-party systems.

You must comply with the terms of any third-party platform you use. Fx Technology LTD is not responsible for third-party content, practices, or availability.

11. Intellectual Property

All intellectual property related to the Platform and Services is owned by or licensed to Fx Technology LTD, including:

  • software, algorithms, and architecture;
  • trademarks, branding, and logos;
  • website/app content;
  • the design, compilation, and overall look and feel of the Platform.

You may not copy, modify, distribute, reverse engineer, or use our intellectual property except as expressly permitted.

Feedback

If you provide feedback or suggestions, you agree that Fx Technology LTD may use them without compensation or obligation.

12. Disclaimer of Warranties

The Platform and Services are provided “as is” and “as available.”

To the maximum extent permitted by law, we provide no warranties of any kind, including regarding:

  • uptime, uninterrupted service, or error-free operation;
  • specific data speeds or coverage;
  • fitness for a particular purpose.

13. Limitation of Liability

To the fullest extent permitted by law:

  • Fx Technology LTD shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, business, or reputation.
  • Our total aggregate liability to you shall not exceed USD 100.00 (one hundred US dollars).

Nothing excludes liability that cannot legally be excluded (e.g., for fraud or personal injury caused by negligence).

14. Indemnification

You agree to indemnify and hold harmless Fx Technology LTD, its officers, employees, and partners from claims, losses, or expenses arising from:

  • your use or misuse of the Services;
  • your breach of these Terms;
  • your violation of applicable laws;
  • any third-party claims related to your actions.

15. Modifications to Terms

We may update these Terms at any time. Material updates will be communicated via the Platform or email (if available).

Updates take effect upon publication. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

16. Suspension & Termination

We may suspend or terminate your access if:

  • you violate these Terms;
  • we suspect illegal or abusive behaviour;
  • required by law or regulatory authorities;
  • we discontinue any Service.

You may stop using the Platform at any time. Termination does not entitle you to refunds unless expressly stated.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over disputes arising from these Terms.

18. Class Action Waiver

To the extent permitted by law:

  • disputes must be resolved individually,
  • you waive the right to participate in class, collective, or representative actions.

19. Severability

If any part of these Terms is found unenforceable, the remainder continues in full force.
